Alba was approached by a software company. The company provided a niche service to recruitment consultancies, and had developed a niche product to support that sector.
The software company engaged clients on the basis of a contract for a set period of time. Over this period, the service would be provided in exchange for a monthly fee. One particular client terminated the contract significantly in advance of the stated end date, expressing dissatisfaction with the product. The software company disagreed with this, and considered the termination was wrongful. It wrote to its client seeking payment of the balance of the fee over the unexpired period of the contract. In response, it received a lengthy letter from a solicitor proving numerous reasons why the fee would not be paid.
The Solution:
Alba carried out a review of the case, and considered the software company had a good claim. It then passed the matter onto a panel law firm, who undertook the work on a contingent fee (‘no win no fee’) basis.
The panel law firm then wrote to the solicitor, providing lengthy and detailed reasons why the fee was due. Despite the initial strong tone of the recruitment company’s solicitor’s letter, a period of negotiation then ensued. This culminated in a negotiated settlement approximately 6 weeks after the panel law firm’s appointment.
The Result:
This was an extremely satisfactory result for the software company, as they were concerned about the cost of engaging solicitors on an hourly rate. What they needed was certainty as to cost, and this is exactly what they got.
